Following TRR’s public consultation on the draft Quality of Service Regulation in October/November 2011, feedbacks on the proposed Draft Regulation had been received from TVL and Digicel in the form of written submissions. Based on the feedbacks from the two operators and taking the factors into consideration, TRR has taken the decision to split the document into a Guideline and a Regulation for the Publication of Data and Information, to be introduced following the publication of this Quality of Service Guideline.

On 14 November 2012, TRR has issued a Regulation on Radio Apparatus and Spectrum Licence (Fees) 2012. The purpose of this Regulation is to establish a framework for the prescribing and enforcement of fees and charges in respect of radio apparatus licences and spectrum licences.

The prescribing of licence fees and their enforcement is two-fold:

To ensure that spectrum usage is properly managed, ensuring that anyone using radio transmission equipment pays a nominal fee for the right to use the national resource; and

To ensure that the cost of the spectrum administration is recovered. This also ensures that only those who use the spectrum pay the fees and for spectrum management and the administrative costs of the Regulator is not allocated by the Government from the national budget.

TRR issued this notice in accordance with clause 8.12(c) of the Competition Guideline, where it stated that “If TRR decides to accept the complaint, send a copy of the non-confidential filing….to the service provider whose conduct is the subject of the complaint and publish a notice on its website announcing the investigation”.

In early November 2012, Telecom Vanuatu Limited (TVL) formally lodged a complaint to TRR for investigation. In its complaint, TVL alleged some conduct of Digicel (Vanuatu) Limited to be in violation of section 23 of the Telecommunications and Radiocommunications Regulation Act 2009. After initially reviewing the complaint, TRR accept the complaints and forward a non-confidential copy to Digicel for response before TRR make a final determination. The investigation is now in process.

Due to a low number of responses and further to requests from stakeholders TRR has extended the deadline for responses to the consultation paper “Consultation on Future Arrangements of the .vu country code Top Level Domain (ccTLD) Management.” to the 7th January 2013.

TRR has today, published the Official Government Gazette copy of the Radio Apparatus Licence and Spectrum Licence (Fees) Regulation. An approved, but un-gazetted copy was uploaded to the TRR website in November 2012, whilst the document underwent the normal processing period through the Government Gazette.
